Bake Me A Cake (BMAC): The business responsible for providing baking products and subsequent decorations.

The Customer: The individual or business that purchases goods from Bake Me A Cake.

The Order Date: The date that cake will be completed and available for collection from BMAC or delivered to the stated venue.

The Product: The cake(s) or baked item(s) as stated on form BMAC-001

Order Form (Doc BMAC-001): The form completed by the customer describing their requirements.

The following terms and conditions are relevant to Bake-Me-A-Cake (BMAC).

Your Design

BMAC will discuss your requirements for your design and colours.

It is the Customers responsibility to check their requirements as set out on the BMAC order form are correct thoroughly before instructing the work. Please ensure the order form clearly states.

  • Order date

  • Number of guests

  • Any allergen / Intolerances

  • A brief description of style/design required

BMAC can only create the finished article from what is interpreted from the wording of your order or consultation.

BMAC will advise the order date is available prior to the customer submitting the order form. This date will be held for 24hrs after which the said date will become available to other potential customers.

As stated later in this form - No booking is confirmed until the agreed deposit or full payment has been paid.

Changes to the previously agreed design may incur extra fees, the balance will be adjusted accordingly.

Every effort will be made to meet the clients design requirements, however in some instances it may not be possible to replicate some designs exactly for copyright reasons.

We will endeavour to discuss any deviation from the client’s initial design requirements however BMAC reserves the right to make minor changes without consultation if necessary.

BMAC will endeavour to match any colour requests for icing but cannot guarantee an exact match as colours present differently in different materials, e.g. Sugarpaste, buttercream & flowerpaste mediums.

Icing colours can be affected by temperature, humidity and particular types of light i.e. sunlight, candles, spotlights.

Darker colours may stain teeth and could have a residual flavour.

BMAC reserves the right to determine the quality of the colour match.

BMAC reserves the right to use any photographs for display or promotional purposes without compensation to you. This includes various social media platforms. The client should advise otherwise when completing the order form.

Payments

The agreement as set out on form BMAC-001 is made on the understanding that the product(s) described shall be provided for the agreed sum. There will be no discounts nor consideration of fees.

For cakes over £50, a non-refundable deposit of 50% is required from the customer.

Payment of the deposit will not only instigate procurement of materials/ingredients etc but will also secure the order date with BMAC ensuring no additional work is accepted.

For cakes less than £50, full payment is required which is non-refundable.

Completion of document BMAC-001 does not allow the commencement of any work. The deposit must be paid to instigate the work.

The agreement is made on the understanding that the goods described on form BMAC-001 will be provided by the order date for the agreed sum, unless directly affected by any of the following; -

  • Acts of God, that may be deemed to impact delivery of the product. This may include adverse weather conditions, or road hazards etc. (Adverse weather conditions will be at the discretion of BMAC. BMAC will keep the customer informed in these conditions at the time)

  • Any strikes directly affecting the supply of relevant ingredients/raw materials.

The final balance payment is due before collection.

By signing the order form BMAC-001, the customer acknowledges that they are signing the agreement freely and voluntarily. The Customer fully understands these terms & conditions.

Payment of the deposit payment denotes that you have read and accepted all these terms and conditions stated below.

Cancellations & Alterations

If, for any reason the customer cancels their order less than 30 calendar days from the date requested, they will receive no refund of deposit paid.

Should the customer cancel their order prior to the 30-day period, any incurred costs by BMAC will be offset against the deposit, with the remaining balance being refunded to the customer.

Should the customer choose to cancel their order within the above noted period, BMAC may have turned down other potential orders.

In the unlikely event that BMAC needs to cancel your order for any reason, the customer will receive a full refund.

Any alterations the customer wishes to make, must be requested in writing. This can take the form of a WhatsApp message or email to BMAC - trudy@bake-me-a-cake.co.uk.

BMAC cannot guarantee that alterations requested within 1 month of the order date can be accommodated as items / ingredients may need to be ordered in advance.

Any alterations may incur additional cost. BMAC will advise any additional costs at the time of the requested alterations.

Should the customer need to change the date of their order date, please get in touch as soon as possible. The revised order date will be subject to availability, and BMAC will advise at this time.

Allergens & Intolerances

All our products are made in a small kitchen. Although we take all the necessary precautions to prevent any cross-contamination, there is always a risk of cross contamination with other products. For this reason, we cannot guarantee the end product is free from traces of these allergens. The Customer must clearly state on the order form BMAC-001, any special requirements in this regard.

BMAC is not responsible for any effects from placing fresh cut flowers on its product(s) following delivery of the product. This includes, but is not limited to contamination from natural poisons, insecticides, pesticides or growth products.

The customer places fresh flowers on the product(s) at your own risk and responsibility being advised of all the risks.

If non-edible items are placed on the product(s), it is the responsibility of the client to remove any non-edible item before serving. Any non-edible items used in the production of the product(s) will be advised to the Client by BMAC.

BMAC cannot be held responsible for any adverse effect including illness associated with non-edible items. Please make arrangements with the caterer or family members to make sure all items are removed before serving.

BMAC accepts no liability for customers suffering allergic reactions from eating our product(s).

Collection & Delivery

All quoted costs are exclusive of delivery costs unless clearly stated elsewhere.

Collection will be from BMAC’s business premises - 23 Fairfield Avenue, Horley, RH6 7PB unless other arrangements have been agreed.

It is deemed the customer has inspected the product on collection and is satisfied the product is acceptable. Any flaw should be identified by the customer at this time. Damages after this point may not be the responsibility of BMAC.

If the product is collected, the customer assumes full responsibility for the integrity of the product. BMAC will cease any responsibility for any damage to the product once collected.

The customer has been advised that the product(s) should be transported on a flat surface (preferably in an empty boot or passenger footwell – depending on size of cake/car) preferably secured to prevent any slippage.

It is not recommended that product(s) are put on a seat or a passenger knee as the angle can cause damage to the product(s).

BMAC can quote for delivery of your product to the local area. The customer should state on form BMAC-001 any specific delivery timings and point of contact at the venue.

Any quoted delivery charges are calculated on a distance and time basis and will be stated in the order confirmation if applicable.

In the event of the product being delivered it is assumed parking is available close to the venue free of charge. Any incurred parking costs will be chargeable over and above the delivery charge.

BMAC can liaise with the identified caterer or banqueting manager at your venue and assembly of the cake in-situ.

BMAC cease any liability for damage or movement of delivered products once handed to either the client or client’s representatives (this includes caterers, banqueting managers etc etc)

All BMAC products are fragile and require care and attention when handling, storing and displaying to prevent damage occurring. Suitable tables and location should be considered by the client.

When displaying any BMAC product at your venue, the customer should consider avoiding direct sunlight, spotlight or candles which can have adverse effect on the finished product or its decoration. This is more relevant in summer months – it is important that you consider where the product will be displayed. BMAC can provide supplementary advice on this if required.

Hand-painted and butter creamed products are especially susceptible to heat and light damage.

BMAC will photographically record the delivered product as left at any 3rd party venue where the client is not directly in attendance.

BMAC accepts no liability for where products are assembled by others and may have sustained damage during 3rd party assembly or transportation.
